Site access from a public road for heavy traffic.

Getting trucks to a biogas plant, a hall or a farm starts with a decision by the road authority and ends with choosing a pavement for the traffic. Step by step, with the legal basis.

Chain of reasoning

Public road
  1. 01Assumption

The road authority specifies the access location and technical parameters in the permit; it may refuse the permit or limit its duration on grounds arising from technical building regulations or principles of technical knowledge.

    Why

The road authority's permit for the access location is needed whatever the road category.

  2. 02Dependency

Where a building permit application or construction notification is required, the access-location permit is attached. The access-location permit expires if the access is not built within 3 years of issue.

    Why

The road authority's permit is required even where construction of the access needs neither a building permit nor a notification, as is generally the case for municipal and district roads. Its expiry limits the time available to build the access.

  3. 03Next step

How many heavy vehicles, and of what kind, will come to the site?

    Why

Traffic sets the KR traffic category and the choice of pavement structure under the GDDKiA catalogue.

Consent for the location of a site access junction

The location of a junction from a public road is approved by the road authority in a consent that sets out the place and the technical parameters of the junction. The authority may refuse, or issue the consent for a fixed period.

The consent expires if the junction is not built within 3 years of its issue. Building a junction on the basis of the consent does not require a zoning decision (WZ).

02

Design and works in the road reserve

The consent contains a notice of the obligation to obtain the road authority's permit for works in the road reserve before they begin, and of the need to agree with the authority the site plan and the architectural design of the junction, where these are required.

The consent for the location of the junction is attached to the building permit application or to the notification.

03

Notification of a junction onto a national or voivodeship road

As a rule, building junctions onto national and voivodeship roads does not require a building permit, but does require notification; a permit may be required in the cases set out in the Building Law. The notification goes to the voivode, the first-instance authority for works on national and voivodeship roads, who has 21 days to object.

04

When a ZRID applies

The decision granting a road investment permit (ZRID) is issued by the voivode for national and voivodeship roads, or by the district head (starosta) for district and municipal roads, at the request of the relevant road authority, within 90 days.

A private investor therefore does not apply for a ZRID for their own junction. A ZRID arises when the road authority itself carries out an investment in a public road.

Pavement matched to the traffic

The GDDKiA catalogue of typical flexible and semi-rigid pavement structures (annex to order no. 31 of 16 June 2014) classifies traffic from KR1 to KR7 by the total number of equivalent 100 kN axles per design lane over the design period: from 0.03 to 0.09 million for KR1 to more than 52 million for KR7.

The design period is 30 years for motorways and expressways and 20 years for other roads. That is why, before the junction design is prepared, we calculate how many vehicles, and of what kind, will come to the site.
